OVERVIEW

Welcome to EMESA ART. The terms “we”, “us” and “our” refer to EMESA ART, operated by Emesa Art FZE LLC, a business registered in the United Arab Emirates and licensed by Ajman NuVentures Centre Free Zone.

We operate this website and online store, including its information, content, features, products and services (collectively, the “Services”). Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referenced herein, govern your access to and use of the Services.

By visiting our website, creating an account or placing an order, you agree to these Terms. If you do not agree, you should not use the Services.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

You must have the legal capacity to enter into a binding agreement in your country of residence. If you permit a minor to use the Services, you remain responsible for their activity.

You agree to provide accurate, current and complete account, billing, payment and delivery information.

You are responsible for safeguarding your account credentials and for activity carried out through your account. Please notify us promptly if you believe that your account has been accessed without authorization.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

EMESA ART offers metal wall art, decorative metal pieces, customized artwork and related products.

We make reasonable efforts to display product descriptions, dimensions, finishes and colours accurately. However, colours and appearance may vary depending on screen settings, lighting and the characteristics of the material and finish.

Hand-finished and made-to-order products may have minor variations in colour, texture, positioning or dimensions within reasonable manufacturing tolerances. Such minor variations are part of the nature of the product and are not considered defects.

Product descriptions, prices and availability may be updated without notice. We may discontinue products or limit quantities when reasonably necessary.

Nothing in these Terms limits any mandatory consumer right available under applicable law.

SECTION 3 — CUSTOM AND PERSONALIZED ORDERS

Custom products may include customer-provided images, names, text, logos, dimensions, colours, layouts or other instructions.

You are responsible for checking all submitted details, including spelling, measurements, orientation and design instructions.

Where we provide a digital proof or design preview, production may begin after your approval. Your approval confirms that the content and layout shown in the proof are correct. Screen previews are illustrative and may not reproduce the final metal finish or colour exactly.

Changes requested after approval or after production has begun may be unavailable or may involve additional charges and a revised delivery estimate.

You confirm that you own or have permission to use all images, logos, trademarks and other materials you submit. You grant us a limited licence to reproduce, modify and process those materials solely as reasonably necessary to prepare, manufacture and deliver your order.

We may decline content that is unlawful, infringing, hateful, abusive or otherwise inappropriate.

SECTION 4 — ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute final acceptance.

An order is accepted when payment has been successfully processed and we confirm that the order can be fulfilled. We may reject or cancel an order for legitimate reasons, including pricing errors, suspected fraud, unavailable materials, delivery restrictions or violations of these Terms.

If we cancel an order after payment, we will refund the applicable amount through the original payment method.

Please review your order carefully before submitting it. Cancellation or amendment requests are subject to our Refund Policy and may not be possible after production begins, particularly for personalized or made-to-order products.

SECTION 5 — PRICES, TAXES AND PAYMENT

Prices are displayed in the currency selected on the website. The final amount, including applicable taxes, shipping charges or other disclosed fees, will be shown during checkout.

International orders may be subject to customs duties, import taxes or clearance charges imposed by the destination country. Unless expressly stated otherwise, these charges are the customer’s responsibility.

You agree to provide valid and authorized payment information. Payments are processed through Shopify and approved third-party payment providers. We do not directly store complete payment-card details.

Promotions and discount codes may be subject to separate conditions, expiry dates, product exclusions or minimum-order requirements. Only one discount may be used per order unless expressly stated otherwise.

SECTION 6 — SHIPPING AND DELIVERY

Shipping locations, methods, charges and estimated delivery times are described in our Shipping Policy and at checkout.

Delivery dates are estimates and may be affected by production time, carrier delays, customs processing, incorrect delivery information or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address and contact details. Additional costs caused by an incorrect address, refused delivery or repeated delivery attempt may be charged where permitted by law.

Risk of loss or damage passes to you upon delivery to you or your authorized recipient, except where applicable law provides otherwise.

Please inspect the package promptly after delivery and contact us within the period stated in our Refund Policy if an item arrives damaged, defective or incorrect.

SECTION 7 — RETURNS, REFUNDS AND WARRANTIES

Returns, refunds, exchanges, cancellations and damaged-item claims are governed by our Refund Policy:

Because customized and made-to-order products are created according to the customer’s specifications, they may not be eligible for return or cancellation due solely to a change of mind after production begins.

This restriction does not apply where a product is defective, damaged, materially different from the approved order, or where applicable law provides a right to a remedy.

Any product warranty stated on a product page applies in addition to mandatory rights under applicable consumer-protection law.

SECTION 8 — INSTALLATION AND PRODUCT CARE

Customers must follow the installation and care instructions supplied with the product or published on our website.

Wall type, surface condition and mounting requirements vary. You are responsible for using suitable fixings and for confirming that the installation surface can safely support the product. Where appropriate, installation should be carried out by a qualified professional.

EMESA ART is not responsible for damage resulting from incorrect installation, unsuitable fixings, misuse, unauthorized alteration or failure to follow care instructions, except to the extent that liability cannot legally be excluded.

SECTION 9 — INTELLECTUAL PROPERTY

The website and its content—including the EMESA ART name and logo, product designs, photographs, artwork, text, graphics, videos and page layouts—are owned by or licensed to EMESA ART and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, sell, modify, scrape or commercially exploit our content without prior written permission.

Purchasing a product does not transfer intellectual-property rights in its design or artwork unless expressly agreed in writing.

Shopify’s names, trademarks and technology remain the property of Shopify or its licensors.

SECTION 10 — THIRD-PARTY SERVICES AND LINKS

The Services may include tools, payment services, applications or links provided by third parties.

Your use of a third-party service may be governed by that provider’s terms and privacy policy. We are not responsible for third-party websites or services that are outside our reasonable control.

Please review the applicable third-party terms before using those services or making transactions through them.

SECTION 11 — RELATIONSHIP WITH SHOPIFY

EMESA ART is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and EMESA ART.

Shopify is not the seller of our products and is not responsible for fulfilment, product quality, customer service, refunds or disputes relating to purchases from EMESA ART, except where Shopify separately provides a service directly to you.

Because Shopify hosts the store, Shopify processes certain personal information to provide and improve its services. Other service providers, such as payment, delivery and analytics providers, may also process information as described in our Privacy Policy.

Information may be processed in countries other than your country of residence, subject to applicable data-protection requirements.

SECTION 13 — REVIEWS AND FEEDBACK

If you submit a review, photograph, suggestion or other feedback, you confirm that you have the right to submit it and that it is accurate and lawful.

You grant EMESA ART a non-exclusive, worldwide, royalty-free licence to use and display that feedback for operating, improving and promoting the Services.

We may remove feedback that is unlawful, misleading, abusive, infringing or unrelated to the relevant product or Service.

SECTION 14 — PROHIBITED USES

You may not use the Services:

For unlawful, fraudulent or malicious purposes.
To infringe intellectual-property, privacy or other rights.
To submit false, misleading, abusive or harmful content.
To introduce malware or interfere with the website’s security or operation.
To attempt unauthorized access to accounts, systems or data.
To collect personal information without authorization.

To bypass security, access controls, purchase limits or fraud-prevention measures.

We may restrict or terminate access where reasonably necessary to protect customers, EMESA ART, Shopify or other parties.

Occasionally, information may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, availability or delivery estimates.

We may correct errors and update information. If an error materially affects an order already submitted, we will notify you and provide the remedies required by applicable law.

SECTION 16 — DISCLAIMER OF WARRANTIES

We provide the website and Services on an “as available” basis, subject to any express product warranty and mandatory rights under applicable law.

We do not guarantee that the website will always be uninterrupted or error-free. Nothing in these Terms excludes warranties, obligations or remedies that cannot legally be excluded or limited.

SECTION 17 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, EMESA ART will not be liable for indirect, incidental or consequential losses arising from use of the Services or products.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, personal injury caused by negligence, defective products where liability cannot be excluded, or any other liability that applicable law does not permit us to exclude.

Any limitation in these Terms applies only to the extent permitted by the consumer-protection and other applicable laws of the United Arab Emirates.

SECTION 18 — INDEMNITY

Where permitted by law, you agree to compensate EMESA ART for reasonable losses or claims resulting from your unlawful use of the Services, your material breach of these Terms, or your infringement of a third party’s rights.

This section does not apply to losses caused by EMESA ART or to obligations that cannot legally be imposed on a consumer.

SECTION 19 — SUSPENSION AND TERMINATION

We may suspend or terminate access to the Services where reasonably necessary because of fraud, unlawful conduct, security risks or a material violation of these Terms.

Termination does not affect rights or obligations that arose before termination, including payment obligations and provisions that are intended to survive termination.

SECTION 20 — SEVERABILITY AND WAIVER

If any provision of these Terms is found to be unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

A failure or delay in enforcing a provision does not waive the right to enforce it later.

SECTION 21 — GOVERNING LAW AND DISPUTES

These Terms and transactions with EMESA ART are governed by the applicable federal laws of the United Arab Emirates and the laws and regulations applicable in the Emirate of Ajman.

The competent courts of Ajman, United Arab Emirates, will have jurisdiction, subject to any mandatory consumer right to submit a complaint or claim to another competent authority.

Before commencing formal proceedings, we encourage customers to contact us so we can attempt to resolve the matter promptly and fairly.

SECTION 22 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our Services, policies or legal obligations.

The current version will be published on this page with an updated revision date. Material changes will be communicated where required by applicable law.
